ARTICLE 1 – Scope of Application
Les présentes Conditions Générales de Vente (dites « CGV ») s’appliquent, sans restriction ni réserve à l’ensemble des ventes conclues par le Vendeur auprès d’acheteurs non professionnels (« Les Clients ou le Client »), désirant acquérir les produits proposés à la vente (« Les Produits ») par le Vendeur sur le site https://www.ateliertac-hexagone.fr.

The Client is expected to review this information before placing an order. The choice and purchase of a Product are entirely the responsibility of the Client. Product offers are subject to stock availability, as indicated at the time of ordering.
These GTCS are available at all times on the website https://www.ateliertac-hexagone.fr
and take precedence over any other documents.
The Client confirms that they have read and accepted these GTCS by ticking the corresponding box before initiating the online order process on the website https://www.ateliertac-hexagone.fr.
In the absence of evidence to the contrary, the data stored in the Seller’s computer system shall serve as proof of all transactions concluded with the Client.

ARTICLE 2 - Price
Products are sold at the prices applicable on the website https://www.ateliertac-hexagone.fr at the time the order is confirmed by the Seller. Prices are indicated in Euros, excluding and including VAT. Prices reflect any discounts offered by the Seller on the website https://www.ateliertac-hexagone.fr.”
These prices are fixed and not subject to change during their period of validity; however, the Seller reserves the right to modify the prices at any time outside of this period. Prices do not include handling, shipping, transport, and delivery fees, which are charged separately, under the conditions specified on the website and calculated prior to placing the order. The payment required from the Client corresponds to the total purchase amount, including these fees. An invoice is issued by the Seller and provided to the Client upon delivery of the ordered Products.
ARTICLE 3 – Orders
The Client is responsible for selecting the Products they wish to order on the website https://www.ateliertac-hexagone.fr , as follows: The Client selects a Product and adds it to their shopping cart, where it can be removed or modified before confirming the order and accepting these General Terms and Conditions of Sale. The Client then enters their details or logs into their account and chooses a delivery method. Once the information is confirmed, the order is considered final, and the Client is required to make payment according to the specified terms.
Product offers are valid while they are displayed on the website, subject to available stock. A sale will only be deemed confirmed after full payment has been received. The Client is responsible for checking the accuracy of the order and promptly reporting any errors. Any order placed on https://www.ateliertac-hexagone.fr constitutes a distance contract between the Client and the Seller. The Seller reserves the right to cancel or refuse any order from a Client who has an outstanding dispute concerning payment of a previous order. The Client can track the progress of their order on the website.
ARTICLE 3 Bis – User Area – Customer Account
In order to place an order, the Client is required to create an account (personal area). They must register by completing the form presented at the time of their order and agree to provide accurate and truthful information about their identity and contact details, including their email address. The Client is responsible for updating their information and may modify it by logging into their account. To access their personal area and view order history, the Client must log in using the username and password provided after registration, which are strictly personal. The Client must not disclose this information and will be solely responsible for any use of it in the event of unauthorized disclosure.
The Client may also request to unsubscribe by accessing the dedicated page in their personal area or by sending an email to: contact@ateliertac-hexagone.fr. Such deletion will be carried out within a reasonable period.
If the General Terms and Conditions of Sale and/or Use are not respected, the website https://www.ateliertac-hexagone.fr may suspend or close a Client’s account after an electronic notice has been sent and remains unheeded. Any account deletion, for whatever reason, will result in the complete erasure of all the Client’s personal data. Any event due to force majeure that causes a malfunction of the website or server, as well as any interruptions or modifications for maintenance purposes, shall not engage the Seller’s liability. By creating an account, the Client accepts these General Terms and Conditions of Sale.
ARTICLE 4 - Payment conditions
Payment is made via a secure payment system, under the following conditions:
- debit/credit card payment
The price is payable in full by the Client at the time of placing the order. Payment information is transmitted securely using encryption protocols established by the authorized payment provider handling transactions on https://www.ateliertac-hexagone.fr . Payments made by the Client will only be considered final once the Seller has received the funds. The Seller is not required to deliver the Products ordered if full payment has not been made in accordance with the terms above.
ARTICLE 5 - Delivery
Les Produits commandés par le Client seront livrés en France métropolitaine, Belgique, Luxembourg, Pays-Bas, Espagne, Italie, Poland.
Le délai de livraison est mentionné à titre indicatif sur le site du Vendeur lors de la commande du Client sur son site.
La livraison est constituée par le transfert au Client de la possession physique ou du contrôle du Produit. Sauf cas particulier ou indisponibilité d’un ou plusieurs Produits, les Produits commandés seront livrés en une seule fois.
Le Vendeur s’engage à faire ses meilleurs efforts pour livrer les produits commandés par le Client dans les délais ci-dessus précisés.
Si les Produits commandés n’ont pas été livrés dans un délai de 14 jours après la date indicative de livraison, pour toute autre cause que la force majeure ou le fait du Client, la vente pourra être résolue à la demande écrite du Client dans les conditions prévues aux articles L 216-2, L 216-3 et L241-4 du Code de la consommation. Les sommes versées par le Client lui seront alors restituées au plus tard dans les quatorze jours qui suivent la date de dénonciation du contrat, à l’exclusion de toute indemnisation ou retenue.
Les livraisons sont assurées par un transporteur indépendant, à l’adresse mentionnée par le Client lors de la commande et à laquelle le transporteur pourra facilement accéder.
Lorsque le Client s’est lui-même chargé de faire appel à un transporteur qu’il choisit lui-même, la livraison est réputée effectuée dès la remise des Produits commandés par le Vendeur au transporteur qui les a acceptés sans réserve. Le Client reconnaît donc que c’est au transporteur qu’il appartient d’effectuer la livraison et ne dispose d’aucun recours en garantie contre le Vendeur en cas de défaut de livraison des marchandises transportées.
En cas de demande particulière du Client concernant les conditions d’emballage ou de transport des produits commandés, dûment acceptées par écrit par le Vendeur, les coûts y liés feront l’objet d’une facturation spécifique complémentaire, sur devis préalablement accepté par écrit par le Client. Le Client est tenu de vérifier l’état des produits livrés. Il dispose d’un délai de 14 jours à compter de la livraison pour formuler des réclamations par écris par courrier recommandé avec avis de réception, accompagnées de tous les justificatifs y afférents (photos notamment). Passé ce délai et à défaut d’avoir respecté ces formalités, les Produits seront réputés conformes et exempts de tout vice apparent et aucune réclamation ne pourra être valablement acceptée par le Vendeur. Le Vendeur remboursera ou remplacera dans les plus brefs délais et à ses frais, les Produits livrés dont les défauts de conformité ou les vices apparents ou cachés auront été dûment prouvés par le Client, dans les conditions prévues aux articles L 217-4 et suivants du Code de la consommation et celles prévues aux présentes CGV.
Risk of loss or damage to the Products passes to the Client only when they take physical possession of the Products. Until then, the Products travel at the Seller’s risk, except if the Client has selected the carrier. In that case, the risk transfers at the time the Products are handed over to the chosen carrier.
ARTICLE 6 – Transfer of Property Rights
Ownership of the Products will not pass from the Seller to the Client until full payment has been received, irrespective of the Products’ delivery date.
ARTICLE 7 – Right of Cancellation (Withdrawal)
Under the terms of Article L221-18 of the French Consumer Code
"For contracts involving the regular delivery of goods over a defined period, the withdrawal period starts upon receipt of the first item." The right of withdrawal can be exercised online using the attached withdrawal form, also available on the website, or by any other clear statement indicating the Client’s intention to withdraw, including by postal mail or email to the Seller at the contact details provided in ARTICLE 1 of the GTCS. Returned Products must be in their original condition and complete (packaging, accessories, manuals, etc.) to allow resale as new, and must include the purchase invoice. Products that are damaged, dirty, or incomplete will not be accepted. The Client is responsible for return shipping costs. Exchanges (subject to availability) or refunds will be processed within 14 days of the Seller receiving the returned Products under the conditions set out in this article.
ARTICLE 8 – Liability of the Seller – Guarantees
The Products provided by the Seller are covered by:
- the statutory guarantee of conformity, covering Products that are defective, damaged, or do not match the order,
- the statutory guarantee against hidden defects arising from material, design, or manufacturing faults that render the delivered Products unsuitable for use,
Terms Concerning Statutory Guarantees
Pursuant to Article L217-4 of the French Consumer Code
The Seller is obligated to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. The Seller is also responsible for any lack of conformity resulting from packaging, assembly instructions, or installation when such obligations were assigned to them by the contract or carried out under their responsibility.
Pursuant to Article L217-5 of the French Consumer Code
A Product is deemed to conform to the contract if:
1° If it is fit for the purpose for which goods of the same type are normally used and, where appropriate:
– if it matches the description given by the Seller and has the qualities that were presented to the Buyer by way of sample or model;
– if it possesses the qualities a Buyer can reasonably expect based on public statements made by the Seller, the Producer, or their representative, including those in advertising or on labeling;
2° Or if it has the characteristics jointly agreed upon by the parties, or is fit for any particular purpose requested by the Buyer, communicated to the Seller, and accepted by the Seller.
Pursuant to Article L217-12 of the French Consumer Code
Claims for non-conformity must be brought within two years from the delivery of the Product.” – Article 1641, French Civil Code“The Seller is responsible for hidden defects in the sold Product that render it unfit for its intended use, or that so reduce its usefulness that the Buyer would not have purchased it, or would have paid a lower price, had they known of the defect.” – Article 1648, paragraph 1, French Civil Code“Claims for redhibitory defects must be filed by the Buyer within two years from the date the defect is discovered.
Pursuant to Article L217-16 of the French Consumer Code
If the Buyer requests the Seller, during the term of a commercial warranty granted at the time of purchase or repair of a movable item, to perform a repair covered by the warranty, any period during which the item is immobilized for at least seven days will be added to the remaining warranty period. This period starts from the date of the Buyer’s service request, or from the date the item is made available for repair if this occurs after the request.
In order to exercise their rights, the Client must notify the Seller in writing (by email or postal mail) of any non-conformity of the Products or of any hidden defects as soon as they are discovered.
Le Vendeur remboursera, remplacera ou fera réparer les Produits ou pièces sous garantie jugés non conformes ou défectueux.
Shipping fees will be refunded at the charged rate, and return shipping costs will be reimbursed upon submission of proof of payment.
Refunds, replacements, or repairs of Products found to be non-conforming or defective will be processed promptly, and in any case no later than 14 days after the Seller has confirmed the non-conformity or hidden defect. Refunds may be issued by bank transfer or cheque.
The Seller shall not be held liable in the following situations:

- Liability shall also not apply in cases of improper use, professional use, negligence, or failure to maintain the Product by the Client, as well as for normal wear and tear, accidents, or force majeure.
- The photographs and graphics displayed on the website are for illustrative purposes only and do not bind the Seller or incur any liability.
In all cases, the Seller’s warranty is limited to the replacement or refund of Products found to be non-conforming or defective.
ARTICLE 9 - Personnal data
9.1 Personal Data Collection
The personal data collected on https://www.ateliertac-hexagone.fr include the following:
Account opening
When creating a Client/User account:
Full name, postal address, telephone number, and email address.
Payment
For the purpose of processing payments for Products on https://www.ateliertac-hexagone.fr , the site collects financial information related to the Client/User’s bank account or credit card.
9.2 Personal Data Recipients
Personal data are processed by the Seller and its partners for the purpose of fulfilling the contract and ensuring the effective sale and delivery of the Products.
The type(s) of contracting partner(s) are:
- Transport service providers
- Payment processing providers
9.3 Data Controller
The Seller acts as the Data Controller in accordance with the French Data Protection Act (Informatique et Libertés) and, from May 25, 2018, under Regulation 2016/679 (General Data Protection Regulation – GDPR) on the protection of personal data.
9.4 Restriction of Data Processing
Personal data will not be used for advertising or marketing purposes unless the Client has given explicit consent.
9.5 Duration of Personal Data Storage
The Seller will keep the collected data for a period of 5 years, corresponding to the limitation period for contractual civil liability.
9.6 Data Security and Confidentiality
The Seller has put in place organizational, technical, software, and physical measures to ensure the security of personal data and to protect it against alteration, destruction, or unauthorized access. Nevertheless, it should be noted that the Internet is not entirely secure, and the Seller cannot guarantee the security of data during transmission or storage online.
9.7 Implementation of Clients’ and Users’ Rights
Under the applicable personal data protection laws, Clients and Users of https://www.ateliertac-hexagone.fr have the following rights:
- They may update or delete their personal data directly via their customer account.
- They may request the deletion of their account by contacting the email address provided in Article 9.3 ‘Data Controller’.
- They may exercise their right of access to learn what personal data is held about them by contacting the address provided in Article 9.3 ‘Data Controller’.
- If the personal data held by the Seller is inaccurate, they may request that the information be updated by writing to the address indicated in Article 9.3 ‘Data Controller’.
- They may request the erasure of their personal data, in accordance with applicable data protection regulations, by contacting the address provided in Article 9.3 ‘Data Controller’.
- They may also request the portability of the data held by the Seller to another service provider.
- Lastly, they may object to the Seller’s processing of their personal data.
These rights may be exercised, insofar as they do not conflict with the purpose of the processing, by sending a request by mail or email to the Data Controller at the contact details provided above.
The Data Controller is required to respond within a maximum period of one month.
If the Client’s request is denied, the decision must be duly justified.
The Client is informed that if their request is denied, they may lodge a complaint with the CNIL (3 Place de Fontenoy, 75007 PARIS) or take legal action before a competent court.
The Client may be asked to check a box to consent to receiving informational and promotional emails from the Seller. They may withdraw this consent at any time by contacting the Seller (using the contact details above) or by clicking the unsubscribe link.
ARTICLE 10 - Intelectual property
The content of https://www.ateliertac-hexagone.fr is owned by the Seller and its partners and is protected under French and international intellectual property laws. Any full or partial reproduction of this content is strictly prohibited and may constitute copyright infringement.
ARTICLE 11 – Applicable Law – Language
These Terms and Conditions of Sale and the transactions arising from them are governed by French law. They are written in French, and in the event of a translation into one or more foreign languages, only the French version shall be authoritative in the event of any dispute.
ARTICLE 12 – Dispute Resolution
For any complaint, please contact Customer Service at the postal or email address of the Seller indicated in Article 1 of these Terms and Conditions of Sale.
The Client is informed that, in any event, they may use conventional mediation with existing sector-specific mediation bodies or any alternative dispute resolution method (e.g., conciliation) in case of a disagreement.
