Prices do not include handling, shipping, transport, and delivery fees, which are charged separately, under the conditions specified on the website and calculated prior to placing the order.\nThe payment required from the Client corresponds to the total purchase amount, including these fees. An invoice is issued by the Seller and provided to the Client upon delivery of the ordered Products.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-536a82c elementor-widget elementor-widget-heading\" data-id=\"536a82c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 3 \u2013 Orders<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5fd77a9 elementor-widget elementor-widget-text-editor\" data-id=\"5fd77a9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The Client is responsible for selecting the Products they wish to order on the website https:\/\/www.ateliertac-hexagone.fr\n, as follows: The Client selects a Product and adds it to their shopping cart, where it can be removed or modified before confirming the order and accepting these General Terms and Conditions of Sale.\nThe Client then enters their details or logs into their account and chooses a delivery method. Once the information is confirmed, the order is considered final, and the Client is required to make payment according to the specified terms.&nbsp;<\/p><p><br><\/p>\n<p>Product offers are valid while they are displayed on the website, subject to available stock. A sale will only be deemed confirmed after full payment has been received. The Client is responsible for checking the accuracy of the order and promptly reporting any errors. Any order placed on https:\/\/www.ateliertac-hexagone.fr\n constitutes a distance contract between the Client and the Seller. The Seller reserves the right to cancel or refuse any order from a Client who has an outstanding dispute concerning payment of a previous order. The Client must not disclose this information and will be solely responsible for any use of it in the event of unauthorized disclosure.<\/p>\n<p>The Client may also request to unsubscribe by accessing the dedicated page in their personal area or by sending an email to: contact@ateliertac-hexagone.fr. Such deletion will be carried out within a reasonable period.&nbsp;<\/p><p><br><\/p><p>If the General Terms and Conditions of Sale and\/or Use are not respected, the website https:\/\/www.ateliertac-hexagone.fr\n may suspend or close a Client\u2019s account after an electronic notice has been sent and remains unheeded. Any account deletion, for whatever reason, will result in the complete erasure of all the Client\u2019s personal data.\nAny event due to force majeure that causes a malfunction of the website or server, as well as any interruptions or modifications for maintenance purposes, shall not engage the Seller\u2019s liability.\nBy creating an account, the Client accepts these General Terms and Conditions of Sale.&nbsp;<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4a0daad elementor-widget elementor-widget-heading\" data-id=\"4a0daad\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 4 - Payment conditions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-384a66f elementor-widget elementor-widget-text-editor\" data-id=\"384a66f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Payment is made via a secure payment system, under the following conditions:\u00a0<\/p><ul><li>debit\/credit card payment\u00a0<\/li><\/ul><p>The price is payable in full by the Client at the time of placing the order. Payment information is transmitted securely using encryption protocols established by the authorized payment provider handling transactions on https:\/\/www.ateliertac-hexagone.fr\n. Payments made by the Client will only be considered final once the Seller has received the funds. The Seller is not required to deliver the Products ordered if full payment has not been made in accordance with the terms above.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-242b8d4 elementor-widget elementor-widget-heading\" data-id=\"242b8d4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 5 - Delivery<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9091556 elementor-widget elementor-widget-text-editor\" data-id=\"9091556\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Les Produits command\u00e9s par le Client seront livr\u00e9s en France m\u00e9tropolitaine, Belgique, Luxembourg, Pays-Bas, Espagne, Italie, Poland.<\/p><p>Le d\u00e9lai de livraison est mentionn\u00e9 \u00e0 titre indicatif sur le site du Vendeur lors de la commande du Client sur son site.<br \/>La livraison est constitu\u00e9e par le transfert au Client de la possession physique ou du contr\u00f4le du\u00a0Produit. Sauf cas particulier ou indisponibilit\u00e9 d&rsquo;un ou plusieurs Produits, les Produits command\u00e9s seront livr\u00e9s en une seule fois.<br \/>Le Vendeur s&rsquo;engage \u00e0 faire ses meilleurs efforts pour livrer les produits command\u00e9s par le Client\u00a0dans les d\u00e9lais ci-dessus pr\u00e9cis\u00e9s.<\/p><p>Si les Produits command\u00e9s n&rsquo;ont pas \u00e9t\u00e9 livr\u00e9s dans un d\u00e9lai de 14 jours apr\u00e8s la date indicative de livraison, pour toute autre cause que la force majeure ou le fait du Client, la vente pourra \u00eatre r\u00e9solue\u00a0\u00e0 la demande \u00e9crite du Client dans les conditions pr\u00e9vues aux articles L 216-2, L 216-3 et L241-4 du Code de la consommation. Les sommes vers\u00e9es par le Client lui seront alors restitu\u00e9es au plus tard\u00a0dans les quatorze jours qui suivent la date de d\u00e9nonciation du contrat, \u00e0 l&rsquo;exclusion de toute indemnisation ou retenue.<\/p><p>Les livraisons sont assur\u00e9es par un transporteur ind\u00e9pendant, \u00e0 l&rsquo;adresse mentionn\u00e9e par le Client lors de la commande et \u00e0 laquelle le transporteur pourra facilement acc\u00e9der.<br \/>Lorsque le Client s&rsquo;est lui-m\u00eame charg\u00e9 de faire appel \u00e0 un transporteur qu&rsquo;il choisit lui-m\u00eame, la\u00a0livraison est r\u00e9put\u00e9e effectu\u00e9e d\u00e8s la remise des Produits command\u00e9s par le Vendeur au transporteur qui les a accept\u00e9s sans r\u00e9serve. Le Client reconna\u00eet donc que c&rsquo;est au transporteur qu&rsquo;il appartient d&rsquo;effectuer la livraison et ne dispose d&rsquo;aucun recours en garantie contre le Vendeur en cas de d\u00e9faut\u00a0de livraison des marchandises transport\u00e9es.\u00a0<\/p><p>En cas de demande particuli\u00e8re du Client concernant les conditions d&#8217;emballage ou de transport des produits command\u00e9s, d\u00fbment accept\u00e9es par \u00e9crit par le Vendeur, les co\u00fbts y li\u00e9s feront l&rsquo;objet d&rsquo;une facturation sp\u00e9cifique compl\u00e9mentaire, sur devis pr\u00e9alablement accept\u00e9 par \u00e9crit par le Client. Le Client est tenu de v\u00e9rifier l&rsquo;\u00e9tat des produits livr\u00e9s. Il dispose d&rsquo;un d\u00e9lai de\u00a0 14 jours \u00e0 compter de la livraison pour formuler des r\u00e9clamations par \u00e9cris par courrier recommand\u00e9 avec avis de r\u00e9ception, accompagn\u00e9es de tous les justificatifs y aff\u00e9rents (photos notamment). Pass\u00e9 ce d\u00e9lai et \u00e0 d\u00e9faut d&rsquo;avoir respect\u00e9 ces formalit\u00e9s, les Produits seront r\u00e9put\u00e9s conformes et exempts de tout vice apparent et aucune r\u00e9clamation ne pourra \u00eatre valablement accept\u00e9e par le Vendeur. Le Vendeur remboursera ou remplacera dans les plus brefs d\u00e9lais et \u00e0 ses frais, les Produits livr\u00e9s dont les d\u00e9fauts de conformit\u00e9 ou les vices apparents ou cach\u00e9s auront \u00e9t\u00e9 d\u00fbment prouv\u00e9s par le Client, dans les conditions pr\u00e9vues aux articles L 217-4 et suivants du Code de la consommation et celles pr\u00e9vues aux pr\u00e9sentes CGV.<\/p><p>Risk of loss or damage to the Products passes to the Client only when they take physical possession of the Products. Until then, the Products travel at the Seller\u2019s risk, except if the Client has selected the carrier. In that case, the risk transfers at the time the Products are handed over to the chosen carrier.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5312999 elementor-widget elementor-widget-heading\" data-id=\"5312999\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 6 \u2013 Transfer of Property Rights<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c4208f8 elementor-widget elementor-widget-text-editor\" data-id=\"c4208f8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Ownership of the Products will not pass from the Seller to the Client until full payment has been received, irrespective of the Products\u2019 delivery date.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ed464b8 elementor-widget elementor-widget-heading\" data-id=\"ed464b8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 7 \u2013 Right of Cancellation (Withdrawal)<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-10a8f08 elementor-widget elementor-widget-text-editor\" data-id=\"10a8f08\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Under the terms of Article L221-18 of the French Consumer Code\u00a0<\/p><p class=\"translation-block\">\"For contracts involving the regular delivery of goods over a defined period, the withdrawal period starts upon receipt of the first item.\"\nThe right of withdrawal can be exercised online using the attached withdrawal form, also available on the website, or by any other clear statement indicating the Client\u2019s intention to withdraw, including by postal mail or email to the Seller at the contact details provided in ARTICLE 1 of the GTCS.\nReturned Products must be in their original condition and complete (packaging, accessories, manuals, etc.) to allow resale as new, and must include the purchase invoice.\nProducts that are damaged, dirty, or incomplete will not be accepted.\nThe Client is responsible for return shipping costs.\nExchanges (subject to availability) or refunds will be processed within 14 days of the Seller receiving the returned Products under the conditions set out in this article.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9b7b2b2 elementor-widget elementor-widget-heading\" data-id=\"9b7b2b2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 8 \u2013 Liability of the Seller \u2013 Guarantees<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-768177e elementor-widget elementor-widget-text-editor\" data-id=\"768177e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The Products provided by the Seller are covered by:<\/p><ul><li>the statutory guarantee of conformity, covering Products that are defective, damaged, or do not match the order,\u00a0<\/li><li>the statutory guarantee against hidden defects arising from material, design, or manufacturing faults that render the delivered Products unsuitable for use,\u00a0<\/li><\/ul><p>Terms Concerning Statutory Guarantees<\/p><p>\u00a0<\/p><p>Pursuant to Article L217-4 of the French Consumer Code\u00a0<\/p><p>\u00a0The Seller is obligated to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. The Seller is also responsible for any lack of conformity resulting from packaging, assembly instructions, or installation when such obligations were assigned to them by the contract or carried out under their responsibility.\u00a0<\/p><p>\u00a0<\/p><p>Pursuant to Article L217-5 of the French Consumer Code\u00a0<\/p><p>A Product is deemed to conform to the contract if:\u00a0<\/p><p>1\u00b0 If it is fit for the purpose for which goods of the same type are normally used and, where appropriate:\u00a0<\/p><p style=\"padding-left: 40px;\">\u2013 if it matches the description given by the Seller and has the qualities that were presented to the Buyer by way of sample or model;\u00a0<\/p><p style=\"padding-left: 40px;\">\u2013 if it possesses the qualities a Buyer can reasonably expect based on public statements made by the Seller, the Producer, or their representative, including those in advertising or on labeling;\u00a0<\/p><p>2\u00b0 Or if it has the characteristics jointly agreed upon by the parties, or is fit for any particular purpose requested by the Buyer, communicated to the Seller, and accepted by the Seller.\u00a0<\/p><p>\u00a0<\/p><p>Pursuant to Article L217-12 of the French Consumer Code\u00a0<\/p><p>Claims for non-conformity must be brought within two years from the delivery of the Product.\u201d \u2013 Article 1641, French Civil Code\n\n\u201cThe Seller is responsible for hidden defects in the sold Product that render it unfit for its intended use, or that so reduce its usefulness that the Buyer would not have purchased it, or would have paid a lower price, had they known of the defect.\u201d \u2013 Article 1648, paragraph 1, French Civil Code\n\n\u201cClaims for redhibitory defects must be filed by the Buyer within two years from the date the defect is discovered.<\/p><p>\u00a0<\/p><p>Pursuant to Article L217-16 of the French Consumer Code\u00a0<\/p><p>\u00a0If the Buyer requests the Seller, during the term of a commercial warranty granted at the time of purchase or repair of a movable item, to perform a repair covered by the warranty, any period during which the item is immobilized for at least seven days will be added to the remaining warranty period. This period starts from the date of the Buyer\u2019s service request, or from the date the item is made available for repair if this occurs after the request.\u00a0<\/p><p>In order to exercise their rights, the Client must notify the Seller in writing (by email or postal mail) of any non-conformity of the Products or of any hidden defects as soon as they are discovered.<\/p><p>Le Vendeur remboursera, remplacera ou fera r\u00e9parer les Produits ou pi\u00e8ces sous garantie jug\u00e9s non\u00a0conformes ou d\u00e9fectueux.\u00a0<\/p><p>Shipping fees will be refunded at the charged rate, and return shipping costs will be reimbursed upon submission of proof of payment.\u00a0<\/p><p>Refunds, replacements, or repairs of Products found to be non-conforming or defective will be processed promptly, and in any case no later than 14 days after the Seller has confirmed the non-conformity or hidden defect.
